In addition to the drafting of your custom tailored Last Will & Testament, we will provide the drafting of other necessary and important legal documents: - A Living Will - a legal document that spells out medical treatments you would and would not want to be used to keep you alive, as well as addressing other health care decisions, such as pain management or organ donation. - Health Care Proxy - this legally appoints an agent to make healthcare decisions for you when you are incapable of making critical decisions on your own behalf. - A Durable Power of Attorney - provides legal authority for another person to act on your behalf or take care of your financial affairs when you are no longer able to make such decisions (due to incapacity or absence from the country). A power of attorney can be limited to specific situations (house sale, car purchase, etc.), or general to all situations.
We will help assist with specific requests and directives for any of the above documents to your own personal and family situation. In addition to an initial meeting to go over your assets, bequests, and property distributions, we will provide an execution ceremony with witnesses and original copies of all the documents for your files. A Last Will & Testament which is executed with an attorney present has the presumption of being properly executed and legally binding. In Re Tuccio, 38 A.D.3d 791 (2d Dept., 2007).
